The Barn at Sloop Point – Terms, Conditions & Liability Waiver
Effective Date: May 1, 2026
By booking, entering, or using The Barn at Sloop Point property (“Property”), all clients, guests, photographers, videographers, vendors, and attendees acknowledge and agree to the following Terms, Conditions, and Liability Waiver.
1. Property Use
The Barn at Sloop Point is a privately owned property made available for photography sessions, branding sessions, content creation, and approved creative use only. Booking the property grants temporary access to designated areas of the property during the reserved session time.
The Barn at Sloop Point does not provide photography services, event coordination, supervision, styling, props, or production services. Clients are solely responsible for their own photographers, vendors, equipment, setup, creative direction, and session planning.
2. Booking Eligibility
By booking the property, the client confirms they are at least 18 years of age and legally capable of entering into this agreement.
3. Payments & Refunds
All booking payments, retainers, deposits, and fees are subject to the pricing and cancellation policy provided at the time of reservation.
Payments are non-refundable unless otherwise stated in writing. Approved reschedules are subject to availability.
Failure to appear during the reserved session time does not guarantee refund eligibility.
4. Assumption of Risk
Guests understand that the property includes outdoor terrain, gravel, grass, uneven surfaces, wooded areas, structures, natural environmental conditions, and other potential hazards.
By entering the property, all individuals voluntarily assume all risks associated with participation and presence on the property, including but not limited to:
Slips, trips, and falls
Weather-related conditions
Uneven terrain
Insect or animal exposure
Structural or environmental hazards
Injury, illness, property damage, or loss
All guests enter and use the property entirely at their own risk.
5. Release of Liability
To the fullest extent permitted by law, all clients, guests, photographers, videographers, vendors, and attendees release, waive, discharge, and hold harmless The Barn at Sloop Point, its owners, operators, affiliates, and representatives from any and all liability, claims, demands, damages, injuries, losses, actions, or causes of action arising from or related to use of the property.
This release applies to:
Personal injury
Bodily harm
Death
Property damage
Theft or loss of equipment
Accidents occurring on or around the property
6. Responsibility for Guests & Equipment
The booking client is fully responsible for the conduct, supervision, and safety of all guests, children, photographers, vendors, and attendees associated with their reservation.
The Barn at Sloop Point is not responsible for lost, stolen, or damaged equipment or personal belongings.
7. Property Damage
Clients accept financial responsibility for any damage caused to the property, structures, furnishings, landscaping, décor, or surrounding areas by themselves or their guests.
Any intentional damage, negligence, vandalism, or misuse may result in immediate removal from the property and additional repair or replacement charges.
8. Weather & Outdoor Conditions
The property is primarily an outdoor environment and is subject to changing weather conditions. Clients acknowledge that weather, lighting, seasonal conditions, insects, mud, wind, rain, heat, and other environmental factors are outside the control of The Barn at Sloop Point.
No guarantees are made regarding weather or environmental conditions during a scheduled booking.
9. Conduct & Safety
Unsafe, reckless, illegal, or disruptive behavior is strictly prohibited. The Barn at Sloop Point reserves the right to refuse or terminate any session without refund if behavior is deemed unsafe, destructive, inappropriate, or in violation of these terms.
10. Alcohol, Smoking & Illegal Activity
Illegal drugs, unlawful activity, weapons, fireworks, open flames, and hazardous materials are strictly prohibited on the property.
Smoking is only permitted in designated outdoor areas if approved.
Alcohol consumption must comply with all applicable laws and must be pre-approved for any session involving alcohol.
11. Intellectual Property & Website Content
All website content, branding, logos, text, graphics, and media associated with The Barn at Sloop Point are protected and may not be copied, reproduced, or distributed without written permission.
12. Limitation of Liability
The Barn at Sloop Point shall not be held liable for any indirect, incidental, consequential, or special damages arising from the use of the website, booking system, or property.
13. Force Majeure
The Barn at Sloop Point shall not be held responsible for delays, cancellations, interruptions, or inability to provide access due to circumstances beyond reasonable control, including but not limited to severe weather, natural disasters, emergencies, utility failures, government restrictions, or acts of God.
14. Privacy
Use of this website and booking system is also governed by our Privacy Policy.
15. Governing Law
These Terms and Conditions shall be governed and interpreted in accordance with the laws of the State of North Carolina.
